My father accidentally set up a revocable trust leaving everything to my stepmom
My late father was under the impression that he and my stepmother had an irrevocable trust set up. He was wrong. He passed away in September and now we have learned it is actually a revocable trust. It was a mistake. My stepmom is letting her son handle things for her, and has talked her into changing the trust so that he will get everything when she passes, so he can help take care of her sister who has mental-health issues.
This will effectively cut me and my siblings out of any part of my father’s estate. Everything, including their home was supposed to go into the trust, and when both my father and stepmother ended up passing, the home was supposed to be sold and all proceeds split evenly between all of their beneficiaries, including my siblings and me. Is there anything we can do to assure my father’s wishes are granted?

It is stories such as this that give all the wonderful stepmothers out there a bad rap.
There are a few possibilities here: 1) Your father set up a revocable trust by accident and did not properly understand the difference between the two trusts; 2) he set up a joint trust where only his portion of the assets became irrevocable upon his death; or 3) he at some point changed his mind and set up a revocable trust, and left his assets for his second wife to distribute to his respective heirs. Even if #1 occurred, it would be up to you to prove this in a court of law, with the help of an attorney, in the event you contested the terms of this trust. Keep in mind, there are many variables that go into creating a trust, so it highly depends on the terms laid out.
But many obstacles lie ahead. The burden of proof lies on your doorstep, and you should be cognizant of the statute of limitations in your state. “Trust contests must be brought within a certain period following the grantor’s death,” says Brian Liberis, senior estate planner at EP Wealth Advisors, based in Boston, Mass. “So if a court action is necessary, it should be undertaken as soon as possible. In addition, you would likely have the burden to prove that the trust did not reflect your father’s intentions and that a mistake was indeed made.”
“However, some revocable trusts are drafted so that they continue to be revocable until the death of the second spouse,” Liberis told MarketWatch. “If that were the case here, then your stepmother would likely have the authority to change the entire trust and redirect the assets to her children. If that is how this trust was drafted, then your only recourse would be to contest the trust in court, on the grounds that it should be modified/reformed due to a ‘mistake.’ That is, the trust as drafted did not reflect your father’s intentions.”
Principles of fairness
Obtain a copy of the trust, so your attorney can review the terms, and see if there was any evidence that it was poorly constructed and/or if only a share of the assets are revocable. “You would be asking the court to modify/reform the trust on principles of ‘equity,’ or fairness,” Liberis adds. “If, at the time it was executed, it was intended that, upon the death of the second spouse, the property passed 50/50 to the children of each spouse, then principles of fairness would dictate that the trust be reformed to ensure that result — or, at least, so you would argue.”
Your stepmother appears to be intent on ensuring the assets in the revocable trust — or the part of the trust that is revocable — will be inherited by her son. That may be an expensive lesson for you and your father; the surviving spouse will not always adhere to their late partner’s wishes. Whether it’s a large or a small amount of money, the second wife or husband can come to believe that they deserve or are entitled to their late partner’s entire estate. We could argue about the ethics of cutting you out of the picture, but your focus should be her legal entitlement.
If you are successful in your endeavors, be aware that assets deposited in a revocable trust typically receive a step-up in basis, so any capital gains are effectively wiped out. That would, of course, benefit your stepmother. So if he left a $1 million home that was originally purchased for $500,000, any capital gains would be calculated on the home’s value at the time of your father’s death, thus saving her money if she sold it. However, assets in an irrevocable trust may not receive a step-up in basis if they were not included in your father’s taxable estate.
If men were more likely to outlive their wives — women tend to outlive men by about six years, a gap that could narrow or widen depending on the age gap between a couple — step children would be writing more letters about their stepfather. In this column, letters about stepmother’s emptying bank accounts are more prevalent than stepfather’s doing the same thing. But children are also likely to disagree with their father’s wishes, if they believe he has been too generous to his second wife. In the meantime, I wish you a painless resolution to your trust debacle.

Solana’s BONK Climbs To 3rd Place In Dog Coin Market Cap, Leaving FLOKI Behind
In recent weeks, the Solana (SOL) blockchain has been making waves in the crypto world, with its native token SOL experiencing a remarkable uptrend of 46% over the past 30 days. Alongside this surge, Bonk Inu (BONK), the first Solana-based meme coin, has gained significant traction, solidifying its position as the third-largest dog coin by market capitalization, surpassing Floki Inu (FLOKI).
BONK Rockets To New Heights With 845% Surge In 30 Days
The staggering growth of Bonk Inu is evident in its recent performance, achieving an impressive 845% gain over the past 30 days. The meme coin’s remarkable ascent has propelled it to new yearly highs, while SOL experienced a slight pullback from its peak of $65 on December 2.
Despite the temporary setback for SOL, the bullish momentum and renewed interest in Bonk Inu have caught the attention of market participants.
As of now, BONK is trading at $0.0000069712, outperforming the broader crypto market with a remarkable 22.4% uptrend in the past 24 hours, aligning with the positive sentiment surrounding Bitcoin (BTC) and the overall market.
With a market capitalization of approximately $430 million, Bonk Inu currently sits in third place among dog coins, trailing behind the likes of Shiba Inu (SHIB) and Dogecoin (DOGE), which boast market caps of $5 billion and $12 billion, respectively.
CoinGecko data reveals that BONK has witnessed a significant 24-hour trading volume of $65,235,205.16, indicating strong investor interest and active participation in the market.

The future trajectory of Bonk Inu’s uptrend and its potential for further gains remains uncertain. However, should BONK continue to attract investors, it has the potential to dethrone Pepecoin (PEPE) in terms of market capitalization. As of the latest update, PEPE has achieved a market cap of $592 million.
However, it is important to note that Bonk Inu still has a significant gap to bridge to catch up with the largest dog coins in the market in terms of market capitalization, namely SHIB and DOGE. SHIB and DOGE have demonstrated substantial gains and already possess staggering market capitalizations.
Dog Coins Make Strong Push For Year-End Gains
The altcoin SHIB, built on the Ethereum platform and known for its Shiba Inu mascot, continues to demonstrate consistent gains across various time frames.
Notably, SHIB has seen a 14% increase over the past fourteen days and an 18% surge over the past thirty days. These positive trends have allowed the dog coin to achieve a slight year-to-date profit of 0.2% after experiencing a significant downturn in 2022.
Presently, SHIB is trading at $0.00000946, representing a decline of more than 89% from its all-time high (ATH) of $0.00008616, reached in October 2021.
Meanwhile, the meme coin DOGE, which has the backing of Elon Musk, is currently trading at $0.09058. It has witnessed an 18% rise over the past fourteen days and nearly 30% growth over the past thirty days, following a sustained upward trend that began on November 21.
However, in contrast to SHIB’s price action, DOGE has experienced a 12% decline year-to-date and an 87% drop from its ATH of $0.731578 reached in May 2021.
It remains to be seen whether the dog coins will continue to experience further gains throughout the remainder of the year or if a healthy pullback will occur to surpass upper resistance levels for another upward movement.

Jeff Bezos, who founded Amazon out of his Seattle garage in 1994, is leaving the city and moving to Miami to be near his parents and his space company Blue Origin.
Bezos announced the decision in an Instagram post late Thursday, which included a video of him touring one of Amazon’s earliest offices, the garage of his rented home in the Seattle suburb of Bellevue, Washington. It was there that Bezos in 1995 launched Amazon as an online bookseller, before transforming the company into a retail and cloud computing giant.
“I’ve lived in Seattle longer than I’ve lived anywhere else and have so many amazing memories here,” Bezos wrote. “As exciting as the move is, it’s an emotional decision for me. Seattle, you will always have a piece of my heart.”
Amazon’s rapid growth reshaped Seattle, particularly its South Lake Union area, where the company’s headquarters sits. Its rise helped turn Seattle into a tech hub, leading to an influx of highly paid tech workers, but also higher rents and homelessness.
Bezos stepped down as Amazon’s CEO in 2021, turning the helm over to former cloud boss Andy Jassy. Bezos transitioned to executive chair of Amazon’s board.
After stepping down as Amazon CEO, Bezos has spent more time on personal ambitions such as the Earth Fund and Blue Origin, as well as the Washington Post, which he acquired in 2013.
His presence has extended beyond Seattle for some time. Bezos recently spent $150 million for two adjoining properties in Miami’s Indian Creek Village, often referred to as the “billionaire bunker.” He owns other properties around the world.

Hulu has a ton on tap in July 2023, including revivals of “Justified” and “Futurama,” livestreamed concerts and all the shark programming you can handle.
“Justified: City Primeval” (July 19) picks up the story of gunslinging U.S. Marshal Raylan Givens (Timothy Olyphant), after the crime drama “Justified” ended its six-season run on FX in 2015. The limited-series spinoff, based on another Elmore Leonard novel, finds Raylan in Detroit, squaring off against a killer known as the Oklahoma Wildman (Boyd Holbrook). New episodes will stream a day after they air on FX.
Also making a comeback is “Futurama” (July 24), Matt Groening’s animated sci-fi comedy that is back for an 11th season — and fourth revival (it’s been dormant since Comedy Central canceled it in 2013). Meanwhile, the critically acclaimed vampire comedy “What We Do in the Shadows” (July 14) returns for its fifth season, and “This Fool” (July 28), the offbeat comedy about family and gang life in South L.A., is back for its second season.

Global cryptocurrency exchange Binance has terminated its services in the Netherlands, exiting the Dutch market after a failed bid to obtain a virtual asset service provider (VASP) license.
The termination of services is effective immediately, and no new customers from the Netherlands can open an account with the crypto exchange. From July 17 onwards, existing Dutch customers will only be able to withdraw assets from the Binance platform, and no further purchases, trades or deposits will be possible from today.
Binance claimed it explored many alternative avenues to serve Dutch residents in compliance with local regulations. However, no such avenues offered a path to VASP registration.
The crypto exchange is currently sending out emails to its Dutch customers with comprehensive information about the next steps they need to take with their Binance accounts.

In April 2022, the crypto exchange was slapped with an administrative fine of over $3 million for operating in the country without the required license and registration. At the time, the Dutch central bank claimed that Binance had a large customer base in the country and a significant daily trading volume running into billions, thus the hefty penalty.

The crypto exchange stressed in its announcement that it is compliant with European Union standards on preventing money laundering and financing of terrorism rules. Binance cited its registration in EU countries such as France, Italy, Spain, Poland, Sweden and Lithuania to showcase its EU compliance.
Binane’s departure from the Dutch market comes within days of its exit plans from Cyprus surfacing. On June 14, the Cyprus Securities and Exchange Commission put Binance Cyprus “under examination for application for deregistration” on its website. At the time, Binance told Cointelegraph that it is focused on fully complying with the new Markets in Crypto-Assets (MiCA) regulations in the next 18 months and is therefore concentrated on the larger EU market.
